BANKRUPTCY

FEG is a payment scheme established to assist employees who have lost their employment due to the liquidation or bankruptcy of their employer and who are owed certain employee entitlements. FEG covers capped unpaid wages, annual and long service leave, payment in lieu of notice and redundancy pay.

The Australian Securities & Investments Commission (“ASIC”) has issued Insolvency Information Sheets for directors, employees, creditors and shareholders of companies under insolvency administration. These Information Sheets are also endorsed the Australian Restructuring, Insolvency and Turnaround Association (“ARITA”) and gives you a basic understanding of the three (3) most common company insolvency administration procedures:

  • Voluntary Administration;
  • Liquidation; and
  • Receivership.

There’s also a Glossary of commonly used insolvency terms. Copies of the Information Sheets and Glossary can be obtained from ASIC.

The Australian Financial Security Authority (“AFSA”) has numerous publications and documents available online concerning personal insolvency and the operation of the Bankruptcy Act, including pamphlets, fact sheets, current statutory amounts and commonly used forms.
