But what if bankruptcy is unavoidable?

What happens once you’re already bankrupt? And is there any way out before the full three-year term is served? The answer is yes… through a process known as annulment, under Section 73 of the Bankruptcy Act.

The Pathway Out: What Is an Annulment?

A bankruptcy annulment is effectively a deal struck between a bankrupt individual and their creditors that allows the person to be discharged from bankruptcy early.

The process works much like a personal insolvency agreement:

  • The debtor (bankrupt individual) makes a proposal to creditors.
  • This proposal outlines assets, income contributions, and any third-party funds (such as family support or loans).
  • If the return to creditors is better or faster than what they’d receive by waiting out the full bankruptcy term, creditors may vote to approve the offer.

 

To proceed, the proposal must be accepted by 50% of creditors and 75% by value – a high bar, but one that’s often achievable with good communication and transparency.


Why Annulments Succeed More Often Than Insolvency Agreements

Interestingly, annulments are statistically far more successful than personal insolvency agreements, even though the two processes are almost identical.

Liam Bailey, Managing Partner at O’Brien Palmer, says this comes down to timing, psychology, and trust.

“Once someone has already been declared bankrupt, creditors tend to feel that justice has been served. The emotion is gone, and they start making more rational financial decisions.”

By the time a bankruptcy trustee puts forward an annulment proposal, they’ve also had months to investigate the debtor’s affairs. That means they can provide creditors with credible, verified data, not just estimates, and that confidence often leads to a ‘yes’ vote.

A Tale of Two Outcomes

Liam shared one case that highlights the sometimes-illogical nature of creditor behaviour:

“A debtor once offered creditors 20 cents in the dollar through a Personal Insolvency Agreement… and they rejected it. Four months later, after being made bankrupt, they were offered 10 cents in the dollar through an annulment proposal, and creditors accepted it.”

Same debtor. Same creditors. Half the return.
The only difference? The emotional hurdle was gone.

The Benefits of Annulment

Getting out of bankruptcy early doesn’t erase the past, the bankruptcy will still appear on the National Personal Insolvency Index and your credit file… but it can dramatically improve how future lenders view you.

It also:

  • Restores your financial independence faster.
  • Reduces long-term reputational impact.
  • Allows you to rebuild credit and business opportunities sooner.
  • Can deliver creditors a quicker, more efficient return than waiting three years.

When It Works… and When It’s Worth Trying

Annulments often succeed when:

  • The debtor has family support or access to third-party funds.
  • There’s minimal likelihood of further recoveries from the bankruptcy estate.
  • Creditors recognise that immediate repayment, even a smaller one, is better than waiting years for uncertain returns.


In one case handled by O’Brien Palmer, a 78-year-old woman was forced into bankruptcy after guaranteeing her son’s failed business loan. With the help of her family, $50,000 was raised, equating to a 4-cent dividend. Creditors accepted, and she was discharged just three months into bankruptcy.

“That case really highlights the human side of what we do,” says Liam. “It’s not just about numbers, it’s about giving people a genuine second chance.”
